Employer Skilled Visa

Overview

Employer-sponsored visas form part of Australia’s skilled migration program and offer an alternative to points-tested visa pathways. These visas do not require applicants to meet a points threshold and instead rely on nomination by an eligible Australian employer for a genuine, full-time position.

The program covers a wide range of occupations listed on the Medium and Long-Term Strategic Skills List (MLTSSL) or the Regional Occupation List (ROL), including roles in trades, professional services, and management. Applicants must meet specific requirements in terms of skills, work experience, and English language ability.

There are two main pathways under employer-sponsored migration:

  1. Direct Entry Stream – Subclass 186 (Employer Nomination Scheme)

The Subclass 186 visa allows skilled workers to apply directly for permanent residence through employer nomination, without needing to hold a temporary visa first.

Core eligibility requirements include:

  • The nominated occupation must be on the Medium and Long-Term Strategic Skills List (MLTSSL)
  • Minimum of 3 years full-time work experience in the nominated occupation
  • English language ability at Competent English level (IELTS 6 or equivalent)
  • The applicant must be under 45 years of age (limited exemptions apply)
  • The sponsoring employer must be approved, operating legally, and able to demonstrate a genuine position that cannot be filled locally

This stream is ideal for experienced professionals seeking to obtain permanent residency from outside Australia or without prior local work experience.

  1. Temporary-to-Permanent Pathway (SID / 494 → 186 / 191)

This pathway allows skilled professionals to first enter Australia on a temporary skilled visa, gain local experience, and later transition to permanent residency.

Common temporary visa options include:

  1. A) Skills in Demand (SID) Visa

Scheduled to replace the TSS 482 visa from July 2025, the SID visa introduces a tiered structure based on occupation and salary level:

  1. Specialist Skills Pathway – for high-income roles (A$135,000+), with fast-tracked processing
  2. Core Skills Pathway – covers most skilled occupations (A$70,000–135,000 range)
  3. Essential Skills Pathway – targeted at critical but lower-paid roles, with caps and additional conditions

SID visa holders may be eligible to transition to the Subclass 186 visa after completing 2 years of full-time work with their sponsoring employer.

  1. B) Subclass 494 – Skilled Employer Sponsored Regional (Provisional) Visa

The Subclass 494 visa is a 5-year provisional visa designed for skilled workers nominated by employers located in designated regional areas of Australia.

Key features include:

  1. Eligible locations: Most areas outside Sydney, Melbourne, and Brisbane
  2. Occupations: Must be listed on the Regional Occupation List (ROL) or MLTSSL
  3. Employer requirements: Must be registered in a regional area and approved to sponsor workers

Applicant requirements:

  1. Under 45 years of age
  2. Competent English
  3. At least 3 years of relevant full-time work experience

Pathway to Permanent Residency:

After 3 years of living and working in a regional area on a 494 visa, applicants may become eligible for permanent residency through subclass 191.

This pathway is particularly suited to applicants who are open to relocating to regional Australia and looking for a clearly defined PR transition route.
